Terms of Service

These terms govern your use of Takshiva, a school-management platform operated by [Company Legal Name] ("we"). By creating an account or using the service, you ("the School") agree to these terms.

1. The service

Takshiva provides cloud-based software for managing students, attendance, fees, exams, HR, communication, and related school operations, plus parent/teacher/student mobile apps. Features vary by subscription plan.

2. Accounts & eligibility

You must provide accurate school and contact details and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Free trial

New schools may start a 14-day free trial, no credit card required. At the end of the trial, you may choose a paid plan or your account is paused.

4. Fees & billing

  • Subscription fees are shown on our pricing page and at signup, and are billed per the plan and cycle you select (monthly/yearly). Prices exclude applicable GST.
  • Pass-through charges — SMS, WhatsApp, and payment-gateway transaction fees are charged at cost (no markup) based on usage.
  • Non-payment may lead to suspension. See our Refund & Cancellation Policy.

5. Your data & content

The School owns all data it enters. We process it only to provide the service (see Privacy Policy). You are responsible for having the lawful basis/consent to upload student and parent data.

6. Acceptable use

You agree not to misuse the service, attempt to breach security, upload unlawful content, or resell the platform without authorisation.

7. Availability

We aim for high availability but do not guarantee uninterrupted service; planned maintenance and factors beyond our control may cause downtime. We take regular backups.

8. Limitation of liability

The service is provided "as is". To the extent permitted by law, our aggregate liability is limited to the fees paid by the School in the preceding three months. We are not liable for indirect or consequential losses.

9. Termination

Either party may terminate per the plan terms. On termination we provide a data export window (see Privacy Policy) before deletion.

10. Governing law

These terms are governed by the laws of India; courts at [City] have jurisdiction.
